{"id":111429,"date":"2025-08-18T18:07:57","date_gmt":"2025-08-18T21:07:57","guid":{"rendered":"https:\/\/portalmovil.com.ar\/?p=111429"},"modified":"2025-08-18T18:08:00","modified_gmt":"2025-08-18T21:08:00","slug":"un-juez-declaro-inconstitucional-el-veto-de-milei-a-la-ley-de-emergencia-en-discapacidad","status":"publish","type":"post","link":"https:\/\/portalmovil.com.ar\/index.php\/2025\/08\/18\/un-juez-declaro-inconstitucional-el-veto-de-milei-a-la-ley-de-emergencia-en-discapacidad\/","title":{"rendered":"Un juez declar\u00f3 inconstitucional el veto de Milei a la Ley de Emergencia en Discapacidad"},"content":{"rendered":"\n<p>El juez federal de Campana,&nbsp;<strong>Adri\u00e1n Gonz\u00e1lez Charvay<\/strong>,&nbsp;<strong>declar\u00f3 este lunes inv\u00e1lido el veto del presidente Javier Milei a la Ley 27.793 de Emergencia en Discapacidad<\/strong>, sancionada por el Congreso el pasado 10 de junio.<\/p>\n\n\n\n<p><strong>El magistrado resolvi\u00f3 \u201chacer lugar parcialmente\u201d a una acci\u00f3n de amparo presentada por una familia con dos hijos con discapacidad y subray\u00f3 que el derecho a la salud, educaci\u00f3n y rehabilitaci\u00f3n de los menores debe tener prioridad frente a los recortes presupuestarios<\/strong>.<\/p>\n\n\n\n<p>En su fallo, Gonz\u00e1lez Charvay&nbsp;<strong>se\u00f1al\u00f3 que los afectados se encuentran en una situaci\u00f3n de \u201cm\u00faltiple vulnerabilidad\u201d<\/strong>&nbsp;y que, por lo tanto, merecen una protecci\u00f3n reforzada conforme a la Constituci\u00f3n Nacional y a tratados internacionales como la Convenci\u00f3n sobre los Derechos de las Personas con Discapacidad y la Convenci\u00f3n sobre los Derechos del Ni\u00f1o.<\/p>\n\n\n\n<p><strong>El Ejecutivo hab\u00eda fundamentado el veto argumentando que la ley generaba un gasto de m\u00e1s de 7 billones de pesos en 2025 y 17 billones en 2026 sin detallar la fuente de financiamiento.<\/strong>&nbsp;Sin embargo,<strong>&nbsp;el juez consider\u00f3 que esa justificaci\u00f3n era \u201caparente y falaz\u201d, al desconocer la posibilidad de reasignaci\u00f3n presupuestaria que posee el jefe de Gabinete y el tr\u00e1mite parlamentario cumplido<\/strong>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>El juez federal de Campana,&nbsp;Adri\u00e1n Gonz\u00e1lez Charvay,&nbsp;declar\u00f3 este lunes inv\u00e1lido el veto del presidente Javier Milei a la Ley 27.793 de Emergencia en Discapacidad, sancionada por el Congreso el pasado 10 de junio.
